A new year is upon us and many are looking forward to what will happen in 2021. For many, this last year wasn’t too lucrative. For Strike 3 Holdings, however; well, let’s check the court dockets for a recap.
How many lawsuits has Strike 3 Holdings filed?
Since September 25, 2017 — when Strike 3 Holdings filed its very first federal lawsuit — the pornographer plaintiff has filed 4343 federal lawsuits nationwide.
Within 2020, however, Strike 3 Holdings filed just 824 federal lawsuits. These included cases filed in the federal district courts in California (Central, Northern, and Southern districts), Connecticut, District of Columbia, Florida (Middle and Southern districts), Illinois, Maryland, Michigan (Eastern and Western districts), New Jersey, New York (Eastern, Northern, and Southern districts), Nevada District Court, Pennsylvania (Eastern and Middle districts), and Virginia (Eastern District).
Wait, you say, only 824 cases all year? In the years before 2020, Strike 3 averaged 121 lawsuits a month; so it it decreased its litigation?
Not really. Although the number of its lawsuits in federal courts decreased, the number of IP addresses it sued actually increased. Toward the end of 2019, Strike 3 Holdings discovered that it could shift its litigation strategy by filing lawsuits in Florida state county court instead of federal court — and achieve the same results with less money spent in filing fees and far fewer complaints to draft. Those Florida cases became the bulk of Strike 3 Holding’s litigation in 2020.
These “New Bill of Discovery” cases it filed in Miami-Dade County, Florida, are each against mass numbers of John Does — sometimes more than 100. To date, it has filed 63 of those cases in Miami-Dade County Court. In 2020, it filed 47 of those 63 cases, with the most recent one, Case No. 2020-031249-CC-05, on December 30, 2020.
While 47 cases in state court might seem a paltry number compared to 824 in federal courts, when you consider that each of those 47 cases was against 50 or more (sometimes 100 or more) John Does, you realize that, in 2020, Strike 3 essentially litigated against more than 2500 in Miami Dade County.
