After filing suit, Strike 3 Holdings asks the court, in a motion, if it can issue a subpoena onto the John Doe’s internet service provided. In almost all cases, the court grants the motion, and Strike 3 sends out the subpoena. The Internet Service Provider, frequently Comcast, then sends a letter to its subscriber notifying it of the lawsuit. The subpoena seeks the subscriber’s name and address, which Strike 3 will use to determine whether to serve its lawsuit upon that individual, as Defendant, or someone else who lives in the household. (It performs public record searches to see who else lives in the household.)

After receiving the letter from Comcast, the subscriber has an opportunity to move to “quash” the subpoena. However, in the federal courts in Florida, motions to quash are almost always denied.
