What is Strike 3 Holdings?
Strike 3 Holdings, LLC is a film production company that produces and distributes adult content. It has gained notoriety for frequent and widespread legal actions against individuals accused of downloading its films illegally via BitTorrent. Sometimes referred to as a “copyright troll,” similar to Malibu Media, Strike 3 Holdings aggressively pursues lawsuits to combat piracy of its content.
How Strike 3’s Process Works
Strike 3 Holdings lawsuits begin with the filing of a complaint in a federal district court against an anonymous defendant, known as “John Doe,” who is identified only by their IP address. The lawsuits are usually filed in the district court in the geographic location where the IP address is based. Although an IP address can in most cases reveal a general geographic location, it does not reveal who owns the Internet account associated with it.
After filing each lawsuit, Strike 3 Holdings files a motion to request the court’s permission to serve a subpoena on the Internet Service Provider (ISP) to obtain the subscriber’s identity (name and address). (This is the same process utilized by Malibu Media and other BitTorrent plaintiffs.)
Strike 3 then sends a subpoena to the ISP, who sends a letter to its subscriber, alerting them to the Strike 3 Holdings lawsuit — and the impending disclosure of their personal information. This letter is often the first time the subscriber learns of the lawsuit.
