If you ever get served with a summons – never ignore it! I just was able to avoid a client from getting default in a case where the Plaintiff was asking for $150,000 per infringement for 16 (allegedly) copyrighted works – a total of $2.4 million! (I know!) I don’t know if the court would have agreed to such an amount, which in my opinion is excessive and unconstitutional, but I don’t think anyone should be placed in a position to even have to argue whether it a $2.4 million judgment, obtained through default, was excessive. Ignoring a summons can result in an enormous judgment – especially in the BitTorrent/illegal downloading cases! Don’t do it!
